A man appeared in Naas District Court today charged with speeding near Naas last year.
However Jim Whelehan (67) from Toomevara in Co Tipperary said he didn't receive his fine in the post until it was too late to pay it.
Mr Whelehan said there are seven other people in his local area with the 'Whelehan' surname and letters often go to the incorrect house.
He said under oath in the witness box: "I've had trouble in the past. I've got the wrong post and other people got my post. "
He added: "I got this speeding notice a full 58 days after the speeding offence. But by then it was too late to pay it."
After listening to the evidence, Judge Desmond Zaidan decided to strike out the case.
