Naas Court hears woman tell how ex punched her 'over and over again'

Naas District Court heard a woman tell that her boyfriend of four months 'punched' her 'over and over again.'

Pictures were presented to the court of a woman with two black eyes and blood-splattered clothing.

A man appeared before Naas District Court earlier this week, charged with Section 3 assault, in a Co Kildare home, on July 5, 2016.

Evidence was heard how the woman's young children were in the house when the attack is understood to have taken  place.

She outlined in evidence how they were in the 'process of breaking up.'

The woman alleged that the evening prior to the attack, she alleged that the accused had been receiving naked pictures from other women.

In court the accused denied that he had been exchanging naked pictures at the time, but said that he had been before he met the injured party.

She said that on the night they had an argument about the naked pictures and that he accused her of not loving him enough.

The court heard how they had an argument and that they later resolved it.

On July 5, 2016, she told the court that she received a text from her ex-husband and that the accused 'snapped the phone' out of her hand.

She said: "He completely changed. His whole face changed, he pushed me, I pushed him back. He grabbed me by the hair, he had his hands on me."

The injured party outlined that her son told him to get off his mother and that she told her son to go to his room and lock the door.

She told the court how he pushed her when going up the stairs and that she had to hold on to him so that she did not fall backwards on the stairs.

The court heard how he pulled a chunk of her hair.

She said: "He punched me over and over again."

The court heard how a neighbour called to her and that she went to Naas Accident & Emergency Services.

Photos revealed in court that there were bruises on her arms, hips, shoulders and sides of arms,scratch marks and lots of discolouration in her skin.

She told the court how she left the country with her children eight weeks afterwards to go live with her family abroad.

In court she said that the accused would get up at 8.30am in the morning and have a drink.

She said: "He was never working, he took money off me. He used me for materialistic gain."

Defence Solicitor, Timmy Kennelly said that the accused would say that he did not hit her on the night.

Mr Kennelly said: "He believes that your mental state was so precarious that you may have caused this to yourself."

She denied this accusation and said: "I have never done anything like this to myself."

In court, Garda David Maher said that on July 5, 2016, he met the defendant with a suitcase at the entrance to the housing estate where the injured party was living.

The court heard how the  Garda spoke to the accused for two to three minutes.

In court he outlined that the injured party was 'covered in blood.'

The accused gave a statement and said that the relationship was a 'whirlwind romance.'

In the statement he said: "When she is sober, she is a fantastic girl."

The accused's statement said that on the night, the injured party kept accusing him of not loving her.

At Naas District Court, the accused said that on the night they were watching television and that she got a text from an ex-boyfriend. An argument arose and the accused told her that she was welcome to him, the court heard.

He alleged that on the night the injured party was on her second bottle of wine and that he had a can of Coors.

The accused said that she scratched her on the face and followed him upstairs and was shouting at her and that it was not the first time.

The accused said at the time he had been actively seeking work and on the night in question had been preparing for an interview the following day.

In court the accused claims that the bruises could have been sustained as the injured party 'bruises easily.'

He said: "She has a problem with iron levels.I would not harm a woman."

In court, the accused says that he contacted the Gardaí. This could not be confirmed in court, there was a record of the injured party contacting Gardaí.

Garda Maher told the court that there was no smell of alcohol off either the accused or injured party.

He recalled that there was an empty bottle of wine at the kitchen sink.

Addressing the accused, Judge Desmond Zaidan said: "You should be ashamed of yourself, the extent to which you have lied, to blame the victim. You tried every excuse. If you don't get psychiatric help, you are a serious threat to the next female that you meet."

Judge Zaidan imposed the maximum sentence of 12 months and ordered that he is fully assessed, recognisances in the event of appeal were set at €500, with an independent surety of €2,000.

Judge Zaidan imposed reporting restrictions to protect the children.
