The probation act was applied to a Monastervin man who was charged with not having tax and NCT at Naas District Court.
Evidence was given that the man had no previous convictions.
Defence Barrister, Sarah Connolly, outlined that the accused needed emergency treatment and had to drive a car without tax and NCT.
Ms Connolly said: "He has had half of his stomach removed."
She outlined to the court that the accused has had difficulties with getting letters delivered to his postal address and accepts that he would have paid the fixed charge notice.
He is currently on illness benefit.
The probation act has been applied.
